SurfYogaBeer - Terms and conditions

1. BOOKING CONTRACT

All bookings are made with SurfYogaBeer LLC (“SYB”, “SurfYogaBeer”, “we”, “our”, or “us”). By booking a trip, you (“participant”, “traveler”, “you”) agree to these Terms & Conditions. If booking for others, you accept these terms for all persons named.

2. ELIGIBILITY & RESPONSIBILITY

• You must be 18+ years old at trip start date.
• By booking, you acknowledge that you accept all risks inherent in adventure travel.
• SYB acts as an independent contractor for suppliers (hotels, transport, activities, etc.) and is not responsible for their acts, omissions, insolvency, or policies.
• Suppliers’ own terms, waivers, and local laws apply.

Assumption of Risk: Adventure travel involves inherent risks including but not limited to physical injury, illness, property damage, or death. By booking, you voluntarily assume all such risks and release SYB, its officers, employees, agents, and contractors from any liability to the maximum extent permitted by law.

3. PRICING, DEPOSITS & PAYMENT

• Prices are in US Dollars and may fluctuate due to currency, taxes, or costs.
• Standard Booking: A 20% deposit is required to secure your spot, with the remaining balance due 6 weeks (42 days) before kickoff.
• Payment Plans: For trips booked 5+ months in advance, you may select a monthly payment plan at checkout. These plans offer $0 down today at a 1% interest rate.
• Failure to complete scheduled payments may result in cancellation and forfeiture of funds already paid.
• SurfYogaBeer is not responsible for any fees from your bank or credit card.

4. TRAVELER INFORMATION

• You must provide accurate information (including full name as per passport, DOB, nationality, emergency contacts, dietary and medical conditions) as requested.
• Failure to submit required information by deadlines may result in additional fees or cancellation as per our policy.

5. FITNESS TO TRAVEL & SPECIAL REQUIREMENTS

• By booking, you certify you are physically and mentally fit for the trip and activities. If you have any condition that may impact your participation, you must inform us before booking.
• We reserve the right to request a medical certificate and to remove or deny any traveler whose behavior or condition is unsafe or disruptive to the group, with no refund.
• We are not responsible for failure to accommodate dietary, allergy, or other special needs.

Medical Emergencies: In the event of accident or illness, you authorize SYB to secure medical treatment on your behalf if deemed necessary, and agree to pay all associated costs. SYB is not responsible for the quality or outcome of any such care.

6. BOOKING CONFIRMATION

• Booking is not final until you receive a confirmation email from SurfYogaBeer.
• We reserve the right to refuse any booking at our sole discretion.

7. CANCELLATIONS & REFUNDS

a. No Refund Policy

• All bookings are non-refundable. Under no circumstances will cash refunds be issued for cancellations, no-shows, or unused portions of a trip.
• The SYB Guarantee: You have until 45 days before the trip starts to cancel and hold 100% of your payments (including your deposit or any payment plan installments) as a one-time travel credit for a future adventure.
• Credit Expiration: Travel credit is valid for 12 months from the date the credit is issued. You must use the credit to book a new trip before this 12-month window expires (the new trip itself can depart at any future date).
• One-Time Use: Credits are non-transferable and can only be applied once. If you cancel a trip that was booked using a credit, that credit is forfeited.
• How to Redeem: To apply your credit, you must first book your new adventure and then email dude@surfyogabeer.com with your new booking confirmation number. Our team will then manually apply the credit to your balance.
• Cancellations within 45 days of departure receive no credit or refund. The same applies to unused portions of trips, no-shows, late arrivals, and early departures for any reason (including illness, medical emergencies, or travel delays).

b. Force Majeure / Events Beyond Our Control

• If SYB must cancel, postpone, or materially alter a trip due to circumstances beyond our control (war, natural disaster, government action, pandemic, terrorism, etc.), we will provide a travel credit for the value paid, minus any unrecoverable costs, to be used on a future trip within one year.
• No cash refunds for force majeure cancellations.

8. TRIP TRANSFERS

• You may transfer your booking or travel credit to a future trip only once, provided you request this at least 45 days before the original trip’s start date.
• Additional transfers are not permitted.
• If you wish to transfer your spot to another person, you must request this in writing and obtain approval from SYB. An administrative fee may apply.

9. TRAVEL INSURANCE

• Travel insurance is required for all participants.
• Insurance must cover personal accident, medical expenses, repatriation, trip cancellation, interruption, and loss/theft of property.
• Proof of insurance must be provided at least two weeks prior to trip start. Failure to provide proof will result in cancellation without refund.
• SYB is not responsible for your insurance arrangements or claims.

10. PASSPORTS, VISAS, & DOCUMENTATION

• You are solely responsible for securing all required travel documents (passport, visas, permits, vaccinations, etc.).
• Your passport must be valid for at least 6 months after your return date.
• SYB is not liable for denied entry, missed flights, or losses due to incomplete or incorrect documentation.

11. TRAVELER CONDUCT & REMOVAL FROM TRIP

• You must comply with all local laws, SYB guidelines, and trip leader instructions.
• The decision of the SYB trip leader is final on all matters affecting safety or group experience.
• We may remove any traveler from a trip (at our sole discretion) for disruptive, unsafe, illegal, or disrespectful behavior—without refund or compensation.
• Any expenses for removal, return, or damages caused are your sole responsibility.

Indemnification: You agree to indemnify and hold harmless SYB and its affiliates from any claims, losses, liabilities, damages, expenses (including attorney’s fees) arising out of your conduct, participation in activities, or violation of these Terms.

12. ITINERARY CHANGES & OPTIONAL ACTIVITIES

• SYB reserves the right to make changes to the itinerary, accommodations, or activities at any time due to operational or safety reasons.
• Optional activities arranged by third parties are at your own risk and cost. SYB is not responsible for their safety, quality, or availability.

13. PHOTOS, VIDEOS & MEDIA RELEASE

• By joining a SYB trip, you grant permission for SYB to use any photos, videos, or testimonials taken during the trip (by SYB staff or other travelers) for marketing and promotional purposes, worldwide and in perpetuity, without compensation.
• To opt out, you must notify us in writing before your trip.

14. LIMITATION OF LIABILITY

• SYB’s liability is limited to the amount paid for your trip.
• SYB is not liable for indirect, consequential, incidental, special, or punitive damages (including lost profits, missed connections, or emotional distress).
• Participation is voluntary and at your own risk; you accept all risks associated with adventure travel.

15. INDEMNIFICATION

You agree to indemnify, defend, and hold harmless SYB, its affiliates, directors, officers, employees, agents, and contractors from and against any claims, losses, liabilities, damages, expenses (including reasonable attorney’s fees) arising out of or in connection with your participation in any SYB trip, your breach of these Terms & Conditions, or your violation of any law or the rights of any third party.

16. COMPLAINTS & CLAIMS

• Any complaint must be reported to your trip leader immediately so we can attempt to resolve it.
• Post-trip complaints must be submitted in writing to dude@surfyogabeer.com within 15 days of the trip’s end.
• Failure to notify us in this timeframe waives your right to further claim.

17. FORCE MAJEURE

• SYB is not liable for delays, changes, or cancellations due to circumstances beyond our reasonable control (force majeure), and is not required to provide refunds, only travel credit as stated in Section 7.

18. SEVERABILITY

• If any provision of these Terms is found to be invalid or unenforceable, the rest remains in effect.

19. JURISDICTION & GOVERNING LAW

• This agreement is governed by the laws of the State of New York, and any dispute shall be brought exclusively in the state or federal courts located in New York.

20. AMENDMENTS TO TERMS

• SYB reserves the right to update these Terms & Conditions at any time. The latest version will always be posted on our website and is binding from the date of posting.

21. RIGHT TO REFUSE SERVICE

• SYB reserves the right to refuse service, accept or decline bookings, or remove travelers from a trip at any time, at our sole discretion, for any lawful reason.

BY BOOKING A TRIP WITH SURFYOGABEER, YOU ACKNOWLEDGE THAT YOU HAVE READ, UNDERSTAND, AND AGREE TO THESE TERMS & CONDITIONS.
